These Terms of Service (“Terms”) govern your access to and use of the Daywise Booking application (the “App”). Daywise Booking (“Daywise,” “we,” “our,” or “us”) is operated by 1497239 B.C. LTD. By using the App, you agree to these Terms.
1. Acceptance of Terms
By accessing or using the App, you confirm that you are at least 18 years of age and legally able to enter into this agreement. If you do not agree to these Terms, you may not use the App.
2. The Service
Daywise Booking provides booking, scheduling, and appointment management tools that allow business users to accept and manage appointments. The App may be embedded into websites or Canva designs.
We may update, modify, or discontinue features of the App at any time.
3. User Accounts
To use the App, you must create an account as a business user. You agree to:
Provide accurate and complete information
Keep your login credentials secure
Be responsible for all activity under your account
Daywise Booking is not responsible for unauthorized access caused by your failure to safeguard your account.
4. Bookings & Customers
Customers booking appointments through your booking page do not create accounts with Daywise Booking. Customers may voluntarily submit information such as their name, email address, and appointment details.
You are solely responsible for:
Managing customer communications
Handling cancellations, reschedules, and no-shows
Complying with applicable laws when collecting customer information
Daywise Booking is not responsible for disputes between you and your customers.
5. Payments & Billing
Certain features may require payment. Payments are processed securely through Stripe. Daywise Booking does not store or process payment card information.
Subscription management, billing, refunds, and disputes are subject to Stripe’s policies. You may upgrade or downgrade your plan at any time through your account settings.
6. Acceptable Use
You agree not to:
Use the App for unlawful, fraudulent, or misleading purposes
Attempt to disrupt, damage, or reverse-engineer the App
Interfere with the security or operation of the App
Misuse integrations or third-party services
Violation of these rules may result in suspension or termination of your account.
7. Canva Platform
When using Daywise Booking within the Canva platform, your use is also subject to Canva’s Terms of Use and policies. Daywise Booking is not responsible for Canva’s services, content, or availability.
8. Account Termination
You may stop using the App or delete your account at any time. We reserve the right to suspend or terminate access to the App if you violate these Terms.
Upon account deletion, all associated account and booking data is removed from our systems.
9. Disclaimer
The App is provided on an “as is” and “as available” basis. We make no warranties regarding uninterrupted service, accuracy, or suitability for your specific needs.
10. Limitation of Liability
To the maximum extent permitted by law, Daywise Booking is not liable for:
Missed or lost bookings
Lost data
Indirect, incidental, or consequential damages
Your use of the App is at your own risk.
11. Governing Law
These Terms are governed by the laws of British Columbia, Canada, without regard to conflict of law principles.
